Under state law, the Planning Commission cannot take action on an item not on the agenda. The Planning Commission may choose to acknowledge the comment or, where appropriate, briefly answer a question, refer the matter to staff, or set the item for discussion at a future meeting.

6. PUBLIC HEARINGS (Minor Review)

7. PUBLIC HEARINGS (Major Review) 

7.1 Development Code Update—Gross Floor Area Definition and Clean-Up Amendments. Denyelle Nishimori, Planning Manager and Laura Dabe, Development Services Technician.

The Town of Truckee is proposing to amend the Development Code definition of Gross Floor Area to create consistency between the California Building Code and Development Code and for clean-up amendments to implement General Plan Land Use Element goals and policies.
Staff Recommendation: That the Planning Commission adopt Resolution 2017-03, recommending approval to the Town Council of 2017 Development Code amendments for the definition of Gross Floor Area (Chapter 18.220) and clean-up amendments, and recommending the amendments to be exempt from CEQA pursuant to Section 15061(b)(3). 

7.2 Application No. 2016-130/AMD Martis Valley Quarry 5-Year Review and Use Permit U83-10  Amendment; Owner/Applicant: Teichert Aggregates; Agent: Michael Smith, Teichert; 13879 Joerger Drive, APN 49-330-06-000. Kirk Skierski, Assistant Planner.

The applicant is requesting a 5-Year Review of the Martis Valley Quarry mining operations and is proposing modifications to the conditions of approval for the original Conditional Use Permit U83-10. The Martis Valley Quarry was originally approved for mining operations by the Nevada County Planning Commission in 1983. As part of the conditions of approval of the original Conditional Use Permit U83-10, the mine operator is required to bring back the application every five years to review the conditions of approval. During this review, the review authority may add, modify, or delete the conditions necessary to continue the Use Permit. 

Staff Recommendation: That the Planning Commission adopt Resolution No. 2017-01 determining the project categorically exempt from CEQA per Section 15061(b)(3) and approving the 5-Year Review and Use Permit U83-10  Amendment subject to the recommended conditions of approval and based on the recommended findings. 

7.3 Application No. 2016-147/DP-UP-MUP Tahoe Donner Association 5-Year Trail Implementation Plan; Owner/Applicant: Tahoe Donner Association; Agent: Gavin Ball. Kirk Skierski, Assistant Planner.

The Tahoe Donner Association is requesting approval of a 5-Year Trail Implementation Plan consisting of 22 individual trail projects designed to enhance Tahoe Donner’s existing trail network and improve environmental conditions. Of the proposed 22 individual projects, only ten are located within town limits and are subject to Town review; the remainder are located wholly within Nevada County, outside the Town boundary. A majority of the individual trail projects propose rehabilitation and erosion control measures to existing trails found within the Tahoe Donner subdivision. The application also proposes four new trails and a new trailhead. Approval of the following land use permits is requested: 

• Development Permit: for greater than 26,000 square feet of project disturbance
• Use Permit: for disturbance of slopes greater than 20 percent
• Minor Use Permit: for development within 200 feet of a wetland

Staff Recommendation: That the Planning Commission adopt Resolution No. 2017-02 approving the Development Permit, Use Permit, and Minor Use Permit subject to the recommended conditions of approval and based on the recommended findings.
