4. PUBLIC COMMENT – This is an opportunity for members of the public to address the Planning Commission on items which are not on this agenda. Please state your name for the record. Comments are limited to three minutes. Written comments should be submitted to the Planning Division 24 hours prior to the meeting to allow for distribution. Under state law the Planning Commission cannot take action on an item not on the agenda. The Planning Commission may choose to acknowledge the comment or, where appropriate, briefly answer a question, refer the matter to staff, or set the item for discussion at a future meeting.

6. PUBLIC HEARINGS

6.1 PUBLIC HEARING: Application No. 12-024/UP-MUP-SP-HDR, Truckee Hostel; Owner/Applicant: Zachary Cowan; 10101 West River Street (APN 19-090-30). Jenna Endres, Associate Planner.

This agenda item will not be heard at this meeting and will be continued to the regular meeting of the Planning Commission on June 18, 2013, at 6:00 p.m.

The applicant is requesting approval of a Use Permit to establish a new hostel at the Alta Hotel on West River Street, a Minor Use Permit to allow for an alternative parking plan, Historic Design Review to make modifications to the exterior of the building and a Sign Plan for new signage. Use Permit approval is needed to allow a hostel/hotel in the DMU (Downtown Mixed Use) zone district. Minor Use Permit approval is needed to forgo the requirement to provide on-site parking. Historic Design Review is needed to permit modifications to the building exterior, which include new siding, windows, balcony railings, and an enclosed ground-floor porch. Sign Plan approval is needed to allow installation of one new wall sign, located on the second floor of the north elevation. The sign, which will read “Truckee Hostel”, will be externally illuminated and mounted directly to the building’s siding.

Staff Recommendation: That the Planning Commission adopt Resolution No. 2013-06 determining the project to be exempt from CEQA pursuant to Section 15061(b)(3) and approving the Use Permit, Historic Design Review and Sign Plan for the project based on the recommended findings and subject to the recommended conditions of approval. Staff is not recommending approval of the Minor Use Permit.

6.2 PUBLIC HEARING: Application No. No. 12-042/UP (Tahoe Donner Ski Hill Cell Tower); Applicant: Tiffany Scalia and Katie Goodin, Scalia Goodin LLP; Owner: Tahoe Donner Association. Yumie Dahn, Assistant Planner.

The applicant is requesting Use Permit approval to construct an unstaffed, multi-carrier telecommunications facility in a 50’x50’ lease area at the top of the Tahoe Donner Downhill Ski area, near the top of an existing ski lift (Eagle Rock Quad Chairlift). The 219-acre parcel is located in the Recreation (REC) zoning district and is accessed by an existing dirt road from Ski Slope Way.

Staff Recommendation: That the Planning Commission adopt Resolution No. 2013-05 determining the project to be categorically exempt from CEQA pursuant to Section 15303 (New Construction) and approve the Use Permit based on the recommended findings and subject to the recommended conditions of approval.

7. STAFF REPORTS

7.1 STAFF REPORT: 2012 Community Development Annual Report. Yumie Dahn, Assistant Planner.

The 2012 annual report on Community Development has been prepared to comply with California Government Code Section 65400(a). The purpose of the report is to inform local decision-makers and the general public on growth, development, and housing issues in Truckee. Information contained in the report includes:

1. The status of the General Plan and the Town’s progress in its implementation;
2. The Town’s progress in meeting its share of regional housing needs;
3. The Town’s efforts to remove governmental constraints to the maintenance, improvements, and development of housing;
4. The degree to which the Town General Plan complies with the State General Plan Guidelines and the date of the last revision plan.

Staff Recommendation: No action is required. This staff report is for informational purposes only. An annual report addressing affordable housing matters and implementation of the General Plan is required by State law. The Town Council reviewed the 2012 Community Development Annual Report at their April 23, 2013 meeting and directed the Community Development Director to file the report with the Governor’s Office of Planning and Research and the State Department of Housing and Community Development. The report was filed on April 24, 2013.

7.2 STAFF REPORT: Application No. 07-063/DC-AMD Development Code Update (Timeline Update). Denyelle Nishimori, Senior Planner.

The Development Code Update process was created by staff to be a flexible process to be responsive to community and Planning Commission direction. The update process also allows staff to move topics around depending on workload, public interest and active land use applications.

Staff Recommendation: That the Planning Commission review the attached Development Code Update Timeline and accept public comment on all active, previously discussed Development Code Update topics. No further action is requested at this time.

7.3 STAFF REPORT: Application No. 07-063/DC AMD Development Code Update (Development Code Amendments) – Home Occupations. Yumie Dahn, Assistant Planner.

This staff report includes both policy discussion and proposed language changes related to Home Occupation Permits in the attached worksheet.

Staff Recommendation: That the Planning Commission review Development Code amendments for the following topic and provide comments to staff: Home Occupations (Section 18.58.120).

7.4 STAFF REPORT: Application No. 07-063/DC-AMD Development Code Update (Phase VIII Development Code Amendments – Clean-Up Amendments). Denyelle Nishimori, Senior Planner.

Staff has identified additional Development Code clean-up amendments and is seeking Planning Commission comments on these amendments.

Staff Recommendation: That the Planning Commission review draft clean-up amendments and provide comments to staff.
