4. PUBLIC COMMENT - This is an opportunity for members of the public to address the Council on items which are not on this agenda. Please state your name for the record. Comments are limited to three minutes. Written comments should be submitted to the Town Clerk 24 hours prior to the meeting to allow for distribution. Under state law the Council cannot take action on an item not on the agenda. The Council may choose to acknowledge the comment or, where appropriate, briefly answer a question, refer the matter to staff, or set the item for discussion at a future meeting.

5.1 Standing Board, Commission and Committee Recognition.

6. CONSENT CALENDAR
6.1 Minutes of November 13, 2012 regular and closed session.
Recommended Action: Approve Minutes.
6.2 Truckee River Legacy Trail Phase 3B – Recreational Trails Program Grant Application.
Recommended Action: Adopt Resolution 2012-44 requesting Recreational Trails Program Grant funds for the Truckee River Legacy Trail Phase 3B Project.
6.3 Solid Waste Ordinance Amendment Addressing Receptacles.
Recommended Action: Waive the second reading and adopt Ordinance 2012-10, to amend the existing Solid Waste Ordinance.
6.4 Notice of Completion for the Bridge/West River Streetscape Improvement Project Capital Improvement Project 60-10-05.
Recommended Action: Authorize the Town Engineer to file a Notice of Completion for the Bridge/West River Streetscape Improvement Project Capital Improvement Project 60-10-05.
6.5 2012 Development Code Update, Ordinance 2012-09, Phase VII Development Code Amendments – Storage/Cargo Shipping Containers, Secondary Residential Unit Separate Driveway, Wetlands, Floodplain Management, Clean-up Amendments (Application 07-063/DC AMD).
Recommended Action: Waive the second reading adopt Ordinance 2012-09, amending the Truckee Municipal Code, Title 18-Development Code for Storage/Cargo-type Shipping Containers, Secondary Residential Unit Separate Driveway, Wetlands, Floodplain Management, and Clean-up Amendments.
6.6 Notice of Completion for the Trout Creek Restoration – Reach 3 Construction Project Capital Improvement Project 60-11-04.
Recommended Action: Authorize the Public Works Director/Town Engineer to file a Notice of Completion for the Trout Creek Restoration – Reach 3 Construction Project Capital Improvement Project 60-11-04, for the total construction contract cost of $924,797.33; and Amend the 2012/2013 Fiscal Year Budget as outlined in the Staff Report.
6.7 Trout Creek Restoration – Lower Reach 1: Waterways Consulting Contract Capital Improvement Project 60-12-03.
Recommended Action: Contingent on approval of the Supplemental Proposition 50 Grant Agreement Amendment by the Department of Water Resources: 1) Authorize the Town Manager to execute a contract for design services with Waterways Consulting, Inc. in the amount of $69,720 for the Trout Creek Restoration – Reach 1 Construction project; 2) Authorize a 10% contingency budget, and 3) Authorize the Town Manager to execute the Supplemental Proposition 50 Grant Agreement Amendment.
6.8 Award of contracts for Town Insurance.
Recommended Action: Award the following contracts for the provision of Employee benefits for Town employees and authorize the Town Manager to execute the contracts to Assurant: for dental insurance in the approximate amount of $77,000; for Group Life insurance, in the approximate amount of $9,400, and for Voluntary Life insurance and Long Term Disability in the approximate amount of $20,000.
6.9 Donner Summit Winter Shuttle Agreement.
Recommended Action: Authorize the Town Manager to enter into an agreement with the North Lake Tahoe Resort Association, Sugar Bowl Corporation, Boreal Ridge Corporation and Donner Summit Resorts, LLC, to operate a shuttle between the Town of Truckee and the Donner Summit Ski resorts during the 2012-2013 winter season, and approve the staff recommendation of providing Dial-A-Ride service Monday through Saturday during the contract period.
6.10 Contract Amendment for Legal Services.
Recommended Action: Authorize the Town Manager to execute Amendment #1 to the Agreement for Legal Services with Jackson Lewis, LLP for a total amount not to exceed $50,000.
7. DISCUSSION ITEMS
7.1 STAFF REPORT – Victory Highway Eagle Monument – Project Update.
Recommended Action: Direct staff to: 1) incorporate the Victory Highway Eagle Monument into the Brickelltown sidewalk project’s plaza design; 2) pursue temporarily placing the monument in the Town Hall lobby; and 3) continue outreach to the stakeholder group, as appropriate.
7.2 PUBLIC HEARING - Truckee Trails & Bikeways Master Plan Amendment.
Recommended Action: Conduct a public hearing, accept public testimony, and adopt Resolution 2012-43 amending the Truckee Trails and Bikeway Master Plan.
7.3 STAFF REPORT – Rescheduling of the December 25, 2012 Regular Council, Redevelopment Successor Agency, and Finance Authority Meetings.
Recommended Action: Direct Staff to reschedule the December 25, 2012 regular meetings to Wednesday, December 19, 2012.

Town of Truckee Redevelopment Successor Agency – Notice of Cancellation
The November 27, 2012 regular meeting of the Truckee Redevelopment Successor Agency is hereby cancelled. Regular meetings are scheduled for the second and fourth Tuesday of each month, immediately following the Town of Truckee Council meeting.
Town of Truckee Public Financing Authority – Notice of Cancellation
The November 27, 2012 regular meeting of the Truckee Public Financing Authority is hereby cancelled. Regular meetings are scheduled for the second and fourth Tuesday of each month, immediately following the Town of Truckee Council meeting.
NOTE: As a sustainable practice a separate agenda for the Public Financing Authority will be provided only if there are items to consider. If the meeting is cancelled the agenda will be combined with the Council Agenda. If there are items for the Public Financing Authority to consider a separate agenda for that body will be produced.
