4. PUBLIC COMMENT – This is an opportunity for members of the public to address the Planning Commission on items which are not on this agenda. Please state your name for the record. Comments are limited to three minutes. Written comments should be submitted to the Planning Division 24 hours prior to the meeting to allow for distribution. Under state law the Planning Commission cannot take action on an item not on the agenda. The Planning Commission may choose to acknowledge the comment or, where appropriate, briefly answer a question, refer the matter to staff, or set the item for discussion at a future meeting.

6. PUBLIC HEARINGS
6.1 PUBLIC HEARING: Application No. 07-063/DC AMD Development Code Update (Development Code Amendments). Jenna Endres, Associate Planner.
The Tahoe Donner Association is requesting approval of a Project Amendment, Development Permit and Use Permit to make improvements to the Marina Facility at Donner Lake on Donner Pass Road. The improvements include grading and terracing for new walkways, sitting areas and beach areas and new rockery walls. The sloped area directly south of the existing snack bar is proposed to be graded for the purposes of installing an outdoor dining area/patio. New lighting and landscaping is also proposed. Approximately 600 cubic yards of cut and 250 cubic yards of fill are proposed. Approximately 20-25 trees are proposed to be removed. No new parking is proposed. A Project Amendment is needed to permit the proposed improvements and amend the underlying Use Permit for the Marina Facility. Development Permit approval is also needed to allow for cumulative disturbance of over 26,000 square feet within the property. Use Permit approval is needed to allow disturbance of slopes greater than 20 percent.
Staff Recommendation: That the Planning Commission adopt Resolution No. 2012-08, determining the project to be exempt from CEQA pursuant to Section 15061(b)(3) and approving the Project Amendment, Development Permit and Use Permit based on the recommended findings and subject to the recommended conditions of approval.
6.2 PUBLIC HEARING: Application No. 07-063/DC AMD Development Code Update (Phase VII Development Code Amendments—Storage Containers on Residential Property, Second Unit Separate Driveway, Wetlands, Floodplain Management and Clean-Up Amendments). Denyelle Nishimori, Senior Planner.
The Town of Truckee is proposing to amend the Development Code to implement General Plan Community Character Element, Land Use Element, and Conservation and Open Space Element goals and policies for State and Federal law consistency.
Staff Recommendation: That the Planning Commission adopt Resolution No. 2012-07, recommending approval to the Council of Phase VII Development Code amendments for storage containers (Section 18.30.151), wetlands (Section 18.46.040 and Article III—Definitions), Floodplain Management (Chapter 18.34), single-family driveway standards for secondary units (Section 18.58.230) and clean-up amendments.
7. STAFF REPORTS
7.1 STAFF REPORT: Application No. 07-063/DC AMD Development Code Update (Timeline Update). Denyelle Nishimori, Senior Planner.
The Development Code Update process was created by staff to be a flexible process to be responsive to community and Planning Commission direction. The update process also allows staff to move topics around depending on workload, public interest and active land use applications.
Staff Recommendation: That the Planning Commission review the attached Development Code Update Timeline and accept public comment on all active, previously discussed Development Code Update topics. No further action is requested at this time.
